PONDS Atlantic Movie Night Competition 2015 TERMS & CONDITIONS

  1. The Promoter is Unilever South Africa (Pty) Ltd (“the Promoter”).  

  1. The promotional competition is open to all South African residents in possession of a valid identity document, except any director, member, partner, employee, agent or consultant of the Promoter, the marketing service providers or any person who directly or indirectly controls or is controlled by these entities, including their spouses, life partners, business partners or immediate family members.  

  1. Any participant under the age of 18 years must be fully assisted by his/her guardian, who approves of and consents to the participant’s participation in the competition and the participant’s receipt/possession of the prize.  

  1. This promotional competition is open from the 1st May 2015 and ends at 12am (midnight) the 30 June 2015.  Any entries received after the closing date will not be considered.  

  1. An SMS entry through the short code 32449 is at a cost of R1.50 per SMS. No free SMS’s or bundled SMS’s apply.

  1. To enter, participants will be required to purchase any POND’S complete solution spot clear even tone facial foam from Clicks participating stores*, and SMS their name, city and the last 4 digits of the barcode to 32449. SMS charged at R1,50.

  1. This competition is open to users of all networks in South Africa; MTN, Vodacom, Cell C, Telkom Mobile and Virgin Mobile.

  1. Participants may enter as many times as they wish provided that each entry is associated with a separate purchase and unique product barcode.  

  1. Participants must enter in their correct contact details. If a winner has given incorrect contact details, the Promoter reserves the right to select another winner.

  1. The prize is 5 of 500 NuMetro movie ticket for one person to watch a particular movie with four of their friends

  1. 100 winners will be selected from each of the following regions:

    1. KZN
    2. Gauteng
    3. Western Cape

  1. The specifications of the prizes are not negotiable.

  1. The promoter will contact the winner with suitable dates to claim the prize.  If the winner is unable to meet the specified date/s the prize will be forfeited.

  1. Winners will be required to provide their name, ID number and contact details and to sign an acknowledgment of receipt of the prize.

  1. Winners will be selected by random draw, on the 1 – 3 July 2015, and will be notified telephonically where the winner will be required to verify their details.
  1. The Promoter (or their agent) will endeavour to contact the prize winner once every day for 2 consecutive working days after their name is drawn.  If the prize winner cannot be contacted during this period, the prize will be forfeited and another winner will be selected in accordance with the rules.

  1. The Promoter will arrange for the delivery of the prize. The Promoter shall not be responsible for any delay in delivery of the prize.

  1. All risk in and ownership to the prize shall pass to the winner on collection thereof.

  1. The winner’s name will be published at www.facebook.com/PONDSSouthAfrica and www.clicks.co.za

  1. The Promoter shall not be responsible for any lost, damaged or delayed entries for any reason whatsoever. Proof of sending will not be accepted as proof of receipt.  

  1. NuMetro Cinema rules also apply in addition to these rules.

  1. The prizes are not exchangeable for cash, are not transferrable and may vary from visual shown.

  1. The Promoter shall have the right to change or terminate the promotional competition immediately and without notice. In the event of such change or termination, all participants agree to waive any rights that they have in respect of this promotional competition and acknowledge that they will have no recourse against the Promoter or its agents.  

  1. The Promoter reserves the right to disqualify any claim if fraud or cheating is suspected, including without limitation, through the manipulation of code or otherwise frequently falsifying data.

  1. NOTE: any attempt to use multiple email accounts or other tactics to enter more than the stated limit may result in disqualification and all associated entries will be void. Entries generated by script, macro, bot, commercial contest subscription, incentives or other means not sponsored by the Promoter, vote-swapping sites, voting software, entering service sites or any other automated means and entries by any means that subvert the entry process or do not conform to the terms or spirit of these competition rules, will void the entry and may disqualify the entrant.

  1. In the event that the prize is not available despite the Promoter’s reasonable endeavours to procure the prize, the Promoter reserves the right to substitute prizes of equal value.  

  1. Neither the Promoter, its agents, its associated companies, nor any directors, officers or employees of such, shall be liable for any loss or damage, whether direct, indirect, consequential or otherwise arising from any cause whatsoever, which may be suffered by the participant.  

  1. The Promoter’s decision is final and no correspondence will be entered into.  

  1. Participation in the promotional competition constitutes acceptance of the promotional competition rules and participants agree to abide by the rules.

  1. By participating in this competition Participants are agreeing to receive future communications from POND’S.  Participants will be allowed to opt-out.

Collection of private information
As used in this privacy policy, 'Personal Information' means information from which you can be personally identified. Typically, this includes your name, street address, screen name and email address, telephone number and credit card information, but may also include other information such as shopping habits, preferences and lifestyle details such as hobbies and interests. If you “Like” the Ponds Facebook page or access or use a Ponds application, your Personal Information may also include your Facebook name, profile picture, gender, networks and any other information you choose to share with everyone or explicitly with Unilever.

Throughout the Sites, you may be asked to provide Personal Information so that you can register for prize draws or competitions, receive information or mailings, use Ponds applications, buy a product or service from us, fill out a survey, make a comment or enquiry, or for a variety of other reasons. Please be assured that Unilever will not collect any Personal Information unless you provide this information voluntarily. When you provide us with Personal Information, you are authorising us to use that information in accordance with the terms of this privacy policy, which includes your right to limit our use of the Personal Information (see 'Who to Contact' below).

Other information we may collect

Cookies
You may have heard of 'cookies,' which are files or pieces of information that may be stored in your computer's hard drive when you visit a website. Unilever uses cookies to make our Sites easier to use and to better tailor the Sites and our products to your interests and needs. Cookies may also be used to help speed up your future activities on our Sites. Pixel Tags

How we use your information
Your Personal Information is used by Unilever for the express purpose for which it was collected (e.g. to respond to your enquiry, enter you in a competition or to send you a sample). It may also be used by us to improve our products and websites, and to contact you regarding other products and services which may be of interest to you (including those we may offer jointly with other companies). We may also share it with or pass it to other companies in the Unilever Group and third parties which directly support Unilever’s promotional activities and website development. Data Processors
At times, we may retain third parties to process and analyse data we collect on our Sites, including Personal Information, to give us insights which we will use to improve our products and our Sites, and track the effectiveness of a particular promotion or campaign (‘Data Processors’). In addition, if you order a product or service from us, we may share Personal Information with suppliers and other third parties to allow delivery of such products or services. Web Analytics Tools

Where we transfer and process your information
The host servers for the Sites are located in the European Economic Area and/or in Republic of South Africa. Unilever and its third party Data Processors will transfer and process your Personal Information within the European Economic Area in accordance with applicable data protection laws and regulations. South Africa currently has no law explicitly protecting Personal Information, but the hosting organisation is required to implement measures to protect your Personal Information and not to process it except in accordance with Unilever’s instructions. Any future hosting organisation used in relation to this site will be similarly bound.

Although the Sites are designed for residents of the Republic of South Africa only, users may be based in other countries. Please do not include Personal Information in any comments you post on or through the Sites, as you may be sharing that information with users based outside the Republic of South Africa in a jurisdiction that does not provide the same level of data protection. Unilever and its third party Data Processors shall not be responsible for Personal Information disclosed in this way.

Security of information
We take reasonable precautions to keep your Personal Information secure and require third party Data Processors to do likewise. Access to your Personal Information is restricted to prevent unauthorised access, modification or misuse and is only permitted among our employees on a need-to-know basis.

Changes in our policy
Unilever reserves the right to change or remove this privacy policy at our discretion. If we decide to change our privacy policy we will post those changes here. We encourage you to visit this area frequently to stay informed.

NO WAIVER
